Subject: Complaint Regarding Illegal Encroachment of Footpath and Open Space by City Centre Mall mumbai central belasis road mumbai 400008
Respected Sir/Madam,
I would like to draw your attention to the footpath and adjoining open space outside City Centre Mall, C.S. No. 243, Mumbai Central. Belasis road mumbai 400008 .The mall owner has illegally encroached upon the footpath-side open space by installing iron grills and steel channels, thereby converting the area into a parking space for two-wheelers.
As a result, pedestrians are facing serious inconvenience. Motorcyclists ride their vehicles over the footpath to access the parking area, creating a constant risk of accidents. Several incidents have occurred where pedestrians were nearly hit by vehicles using the footpath. The footpath is meant exclusively for public movement; however, a significant portion has been occupied and is being used for private parking purposes.
I had previously lodged a complaint with the BMC D Ward regarding this matter. And D. ward only issue notice. I was informed that the case had been forwarded to the Building Proposal Department to verify whether any permission had been granted for the installation of the grills and enclosure.
I respectfully request clarification on whether any approval has actually been granted for this structure. If such approval exists, kindly disclose the basis on which it was granted, considering that the area was originally an open space adjacent to the footpath and its enclosure adversely affects pedestrian access and public convenience.
It is also noteworthy that the BMC Assessment Department has reportedly taken action against the mall due to substantial outstanding property tax arrears amounting to several crores of rupees. It is understood that the property has been brought under the control of the Assessment Department and may be subject to recovery proceedings. Under such circumstances, granting approval for additional encroachments or structures appears contrary to public interest.
Therefore, I humbly request that:
An immediate site inspection be conducted.
The legality of the iron grills, steel channels, and enclosure erected on the footpath-side open space be thoroughly investigated.
If the structure is found to be unauthorized, it should be removed immediately.
The footpath should be restored to its original condition and kept free from parking and encroachments for the benefit and safety of pedestrians.
If any approval has been granted, a copy of the approval along with the supporting documents and reasons for such approval should be made available to the public.
In the interest of public safety and the rights of pedestrians, I request your office to take urgent and appropriate action in this matter.
